澳洲法律论文怎么才能写好？

大多数澳洲法律论文写作离不开以下几部分内容：概述文章性质或范围的介绍，讨论或分析问题的正文(这通常通过使用小标题被分成几个部分)，简要总结讨论并陈述最终立场的结论。同学如果想写好论文，一定要清楚地知道每部分内容的重点。

一、Introduction

Introduction有助于读者定位，这是写一篇结构良好的论文的重要一步。这部分要能够识别提出的问题，陈述主题以及你对此的立场，简要陈述你想写的要点，概述你的论文将如何组织，涵盖定义(如果适用)并确定假设。如果一个问题要求你评估一个案例的优点和缺点，不能仅这样描述：

This essay will assess the advantages and disadvantages of [case].

你还需要给出论点的范围：

In this paper the advantages and disadvantages of [x] are examined. It is argued that the critical role of [one advantage] supports a shift in policy to implement [x], notwithstanding the presence of other disadvantages.

二、Body

Body部分，你将扩展你在Introduction中提供的论点的大纲。每一段应该集中在论点或问题的一个方面，由几个包含证据的句子来支持。通过在正文各节之间使用副标题，向读者表明内容信息。从你最有力的论点开始，讨论并评估你想用阅读材料中的证据来证明的主要观点。用主题句来建立每一段，并在每段系统地讨论一个观点。例如：

1、[The issue of] is currently unresolved.

2、It is well established that …, or It is commonly understood that …

3、Commentators agree that …

4、There is a difference of opinion amongst commentators in relation to …

5、The question of [x] was considered in [case name]. The court held/ Harris J held …

6、The difficulty which this gives rise to is this: …

三、Conclusion

用一个清晰的结论来结束论文是非常重要的，这个结论总结了你提出的论点或者你发现的问题。结论应该简短，应该总结你的主要论点，并清楚地陈述你的结论。不能引入任何新的内容，且必须在逻辑上与你的论点一致。例如：

1、In conclusion by analysing Y it has been argued that X …

2、The concept of [x] has proven difficult to define. In [case] it was described in terms of [description]. However, in [case] it was treated as [having a broader/ narrower scope].

3、It is therefore logical to argue that because of …it is likely to be held that

4、After considering these factors I would advise Smith to …
